3. Quotes and project scope

Quotes are based on the requirements available at the time of issue and remain valid for the period stated. Work outside the agreed written scope is treated as a change request and may affect cost and timeline. Estimated timelines depend on timely client feedback, access, and content.

4. Customer responsibilities

• Provide accurate requirements, content, and access needed to perform the work
• Respond to review requests and approvals within agreed timeframes
• Ensure you have rights to any materials or data you supply to us
• Maintain the confidentiality of credentials issued to you

5. Payments

Fees, payment schedules, and currency are set out in your quote or agreement. Card payments are processed by a third-party PCI DSS compliant payment provider. Invoices are payable by the stated due date; overdue amounts may result in suspension of work.

6. Intellectual property

Ownership of custom deliverables is defined in the project agreement and, unless stated otherwise, transfers to the client on receipt of full payment. Pre-existing materials, frameworks, tools, and third-party or open-source components remain subject to their own ownership and license terms. Website content, branding, and materials published here remain our property.

7. Third-party services

Projects may rely on third-party platforms, hosting, APIs, or libraries governed by their own terms. We are not responsible for the availability, changes, or performance of third-party services.

8. Acceptable use

You must not use this website or our services to break the law, infringe rights, transmit malicious code, attempt unauthorized access, scrape at volume, or interfere with normal operation.

9. Warranties and disclaimers

Except as expressly stated in a signed agreement, this website and its content are provided "as is" without warranties of any kind, whether express or implied, including fitness for a particular purpose. We do not warrant uninterrupted or error-free operation.

10. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data. Our aggregate liability arising from an engagement is limited to the amounts paid for the services giving rise to the claim, except where liability cannot lawfully be limited.

11. Termination

Either party may terminate an engagement in accordance with the project agreement. On termination, fees for work performed and non-cancellable commitments up to the termination date remain payable.

12. Governing law

These terms are governed by the laws of the Commonwealth of Massachusetts, United States, without regard to conflict of law principles, unless a signed agreement provides otherwise.
